1.     INTRODUCTION
1.1.  Welcome to Job Center, the modern, user-friendly online platform for Employers and Job seekers to post and apply for job opportunities across the country.
1.2.  These terms and conditions shall govern your use of the Job Center website.
1.3.  By using this website, you fully accept these terms and conditions. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use or access the Job Center website
1.4.  Please review these terms and policy carefully. Your access to and/or use of the Job Center portal, your acceptance of and consent to be bound by these terms and policy.
1.5.  In this agreement, Terms of Use (“Terms”) state the terms and conditions governing your usage of access to the Job Center portal and constate a legally binding contract between you and the Ministry of Economic Development. These terms incorporate any additional terms and conditions posted by Job Center.
1.6.  Privacy Policy (“Policy”) depicts how Job Center may utilize and disclose information regarding all users and viewers, which may be collected from the website.
1.7.  In the event of a conflict amidst these Terms and/or Policy, and any other applicable terms or agreement completely executed by you and the Ministry of Economic Development (“Other Terms”), the Other Terms shall control.
2.      ELIGIBILITY
2.1.  By using the Job Center website, you confirm that you are of legal age to enter into these Terms.
2.2.  If you are an individual accessing or using the website on behalf of, or for the benefit of, any corporation, partnership or other entity with which you are associated (an “Organization”), then you are agreeing to these Terms on behalf of yourself and such Organization, and you represent and warrant that you have the legal authority to bind such Organization to these Terms.
2.3.  References to “you” and “your” in these Terms will refer to both the individual using the website and to any such Organization.
3.      LICENSE
3.1.  Subject to and conditioned on your compliance with these Terms, Job Center grants you a limited, non-exclusive, non-transferable, non-assignable, revocable license to access and use the portal, and to download copies of the materials that we make available for download on the website, in each case solely for your personal and non-commercial use.
3.2.  The Job Center website, including all content, information, and materials incorporated into or made available through the website, are the exclusive property of the Ministry of Economic Development. You agree not to access or use the website, or any content, information, or materials incorporated into or made available through the website, except as expressly permitted under these Terms.
3.3.  All trademarks, and brand logos displayed on the website are the exclusive property of the Ministry of Economic Development.
4.      USER SUBMITTED MATERIALS
4.1.  The website include functionality to enable you to upload your résumé and/or other employment- and career-related information, without additional consideration to you or any third party, to reproduce, distribute, perform and display (publicly or otherwise), create derivative works of, adapt, modify and otherwise use and exploit such Submitted Materials, in any format or media now known or hereafter developed, and for any purpose (including promotional purposes, such as testimonials).
4.2.  Job Center will have the full rights (but has no obligation to) screen, monitor, evaluate and remove any Submitted Materials at any time and for any reason, or analyze your access to and use of the website. We may disclose information regarding your access to and uses and the circumstances surrounding such access and use, to anyone for any reason or purpose.
4.3.  For clarity, certain information that you provide to Job Center through the website may also be governed by Job Center’s Privacy Policy, detailed below. You represent and warrant that any information you provide in connection with the website are and will remain accurate and complete, and that you will maintain and update such information as needed.
4.4.  By providing the required personal and professional information, the Job Center users hereby acknowledge and agree that the given information can be utilised to perform the required labour and employment analysis; job market analysis and; other analyses as required for the formulation of employment and labour related policies; and will not be used for any other purposes or in any other capacity.
4.5.  The Job Center shall ensure that any information transference or data sharing to a government body or any authorised organisation to be kept anonymous to prevent any breach in confidentiality and user privacy.
5.      RULES OF CONDUCT
5.1.  In connection with the website, you agree NOT to:
a)      Use the website for any commercial purpose, or for any purpose that is fraudulent or otherwise tortious or unlawful.
b)      Interfere with or disrupt the operation of the website or the servers or networks used to make the website available, including by hacking or defacing any portion of the website; or violate any requirement, procedure or policy of such servers or networks.
c)      Restrict or inhibit any other person from using the website.
d)      Reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, timeshare, distribute or otherwise exploit any portion of (or any use of) the website except as expressly authorized herein.
e)      Remove any copyright, trademark or other proprietary rights notice from the Job Center website.
6.      DISCLAIMER
6.1.  Job Center;
(a) explicitly makes no representations or guarantees about job listings or the accuracy of the information provided by the employer and does not guarantee that you will receive any employment or job offers through the Job Center website;
(b) does not endorse or recommend employers, and a posting does not constitute an endorsement or recommendation.
(c) will not be responsible for, and makes no representations regarding any employment offers or listings, safety, wages, working conditions or any other aspect of the employment or pre-employment screenings, employment decisions, or actual employment presented by third parties; and
(d) is neither your employer nor your agent based solely on your usage of this website. You must use your own judgment in evaluating any prospective employers and any Third-Party Materials and;
7.      TERMINATION
7.1.  Job Center may terminate or suspend your access to the website at any time, with or without cause or notice, including if we believe that you have violated or acted inconsistently with the letter or spirit of these Terms. Upon any such termination or suspension, your right to access and use the Site will immediately cease.
8.      NOTICE OF COPYRIGHT INFRINGEMENT
8.1.  Any content that are posted, created or make available through the Job Center portal must be your own, i.e. you must own the rights to those content.
8.2.  We will respond to takedown notices and remove any infringing content if that content is proven to be copyright infringement.
9.     JOB SEEKER REGISTRATION
9.1.  This section 9 applies to you if you are a jobseeker.
9.2.  To be eligible for an individual account on the Job Center portal, you must be of legal age.
9.3.  You may login to this website through your individual efaas account.
10.  JOB SEEKER SERVICES
10.1.  Job seekers who register with this website will have access to additional website features, which we will determine in our sole discretion. These include,
a)         Facility to generate CV, filled with the information provided on the portal.
b)         Facility to enable the job seeker to browse our database of job listing and courses.
c)         Facility to enable the jobseeker to receive notifications through the portal or/and through email.
d)         Facility to view matching employers and jobs.
e)         Any other services specified on our website from time to time.
11.  EMPOYER REGISTRATION
11.1.  This section 11 applies to you, if you are Business / NGO or Educational Institute.
11.2.  You may register on the Job Center website, by filling out the required information in the registration fields.
11.3.  If you are a Business, a “Board resolution for Personnel Authorization document” should be submitted in the case that the registration is completed by an individual other than the Managing Director.
11.4.  If you are a sole proprietor, registration must be completed by the owner only.
11.5.  If you are an Educational Institute, an approval letter from the person in charge must be submitted which must include the specified information of the appointed personnel to access and use the website on behalf of the Institute. (Name and Designation, ID card number, Contact number and email address).
12.  EMPLOYER SERVICES
12.1.          Businesses / NGO’s and Educational Institutes registered with our website will have access to additional features, including:
a)         Ability to post advertisements on the website
b)         Access to our data base of job seekers.
c)         Any other services specified on our website from time to time.
12.2.            Any advertisements you send for approval shall constitute to “your content”.
12.3.            You acknowledge that we merely provide a facility to enable jobseekers and employers to get in touch and that we do not monitor the registered jobseekers. Thus, you agree that we will not / cannot be held liable for any loss, damage or expense suffered due to actions or omissions of a jobseeker.
12.4.            Employers undertake to ensure that all the job posts that are published through our website is accurate, current, complete and non-misleading advertisements for bon fide jobs in compliance with the Employment Act.
12.5.            Employers must treat the information in our database of the jobseekers as confidential and must only use the information for the purpose of seeking candidates to fill vacancies. Employer must not copy any information from the database or record or retain any information from the database or disclose to a third party any information from the database, except as strictly necessary for that purpose. 
12.6.            We do not warrant that employers will receive any application in relation to job postings; nor do we warrant that our database will hold information in regard of jobseekers that are suitably qualified for the vacant positions.
13.  Confidentiality
13.1.           It is the responsibility of the user to keep the Portal’s password(s) secure.
13.2.          If you are an individual accessing or using the website on behalf of, or for the benefit of, any corporation, partnership or other entity with which you are associated (an “Organization”), you will undertake the responsibility not to pass any Portal login information to any parties outside of the (the “Organization”).
13.3.          Registered Businesses / NGO’s or Educational Institutes shall keep Confidential Information as secret and confidential and not disclose it to any third party. The Business / NGO’s or Educational Institute may disclose the Confidential Information only to delegated users assigned by the Business / NGO’s or Educational Institute.
13.4.          The Business / NGO’s or Educational Institute shall undertake responsibility of removing delegates once they are no longer affiliated with the Business / NGO’s or Educational Institute.
